In my opinion, if you know who the person is, it could be a portrait. If you don't know them, I feel you need to see the whole face. This includes shots where the crop cuts into the hairline. Again, my opinions. :)
Using a half covered face is always a good idea for family/friends – especially if the sitter is known for a particular sport – i.e. half hidden behind a foot/rugger or netball, Half hidden re a swimmer in a pool – after all how many bride photos are of a hint of a face behind a lace veil. One I saw was of a keen knitter with her face buried in her wool with knitting needles stuck up from the side – everyone who knew her said that's her even with out seeing her face – another great video Gavin – thanks.
That's a great idea using the "Merge Visible" command, I've never know what the use of that is. Do you know you can also use the Crop Tool to resize the width by just dragging the right side over? It's not precise like the Resize Tool but it works.
I completely agree with you, Gavin, that these are portraits. But to make the doubters happy I would suggest adding a qualifier. So you can say they are "implied portraits". There, problem solved. :)

I would say yes they are portraits because it is still an image of a face, i would also class it as fashion because of the hat

I agree, a portrait is a representation of a person. Covering a persons eyes is no different then a silhouette or a bust sculpture.
